Wrongful Termination
Losing your job after an injury, a complaint or a claim isn’t something you have to accept quietly.
If you have been denied a promotion, been demoted or terminated from your employment based on your race, color, religion, sex, or national origin, you may have a valid claim under Title VII or Florida Statutes Chapter 760 wrongful termination. It’s illegal for an employer to consider these characteristics about promotions, job assignments, stop, or wages.
And it’s illegal for an employer to terminate an employee for refusing to break the law, in retaliation for filing a discrimination or safety claim, for taking leave under the Family and Medical Leave Act. If you have been intimidated, coerced, or terminated for filing a valid workers’ compensation claim, you may claim retaliatory discharge.
Wrongful Termination Variations
- Discrimination: employer terminates employment because due to race, nationality, religion, sex, age, or perhaps, sexual orientation.
- Retaliation: employer fires the employee because the employee filed a discrimination claim.
- It is not permissible for an employer to fire an employee if they refuse to commit an illegal act.
- The company procedure must be followed before an employee is terminated. If the employer fires an employee without following this procedure, the employee may claim wrongful termination.
